Like other cooperating Realtors, my fee is paid by the Seller. The difference is, I am a cooperating Realtor who represents YOU,the Buyer, not the Seller. In terms of time, advice and negotiating power, you save money by using my services as a Buyer's Realtor. The exceptions to this standard occur in the rare instance if you, the Buyer (Principal), decide to purchase a home that is "For Sale By Owner", Bank-owned, Trustee Sale, etc. where the Seller may decline to pay a commission to Casa Tierra Realty. In such cases You the Buyer (Principal) will have the option of looking at such property. In the event You the Buyer (Principal) purchase such property where there is no compensation paid by Seller or only a portion thereof paid by Seller, then Casa Tierra Realty. will be paid by You the Buyer (Principal). The full commission or the portion thereof not paid by Seller will be paid at closing in accordance with Casa Tierra Realty's Schedule of Sales Commissions. Schedule of Sales Commissions:
Definition of Buyer's Broker/Realtor: QUESTION Isn't the Realtor who shows me homes they have listed representing me?
Probably not! Unless you have an agency agreement with a promise of
representation, the Realtor showing you homes will be acting on behalf of the
Seller. And even with an agency agreement the agency and its subRealtors are still obligated to the Seller.
Sellers who "list" their home for sale have signed a listing
contract with the real estate company, Realtor and its sub-Realtors. The listing contract obligates the
real estate company, and all of the firm's Realtors, to represent the seller
in the transaction. This same contract permits the listing Realtor to use
"sub-Realtors" to help find a buyer. The sub-Realtor's role, just like the
listing Realtor's role, is to get the highest possible price and best terms
for the seller.
Unlike traditional Realtors who represent sellers, my mission is to provide professional Realtor Consultation to buyers. This means I am a Realtor for buyers. Undivided loyalty is the primary duty which an Realtor owes to his/her clients. In other words, by law we must put the client's interest first. It also means we must negotiate the best price and terms for our clients and advocate what is best for them. I believe that business relationships are based on honesty, integrity and respect. In view of that, I promote seperate Buyer Realtor and Listing Realtor real estate practices instead of the traditional seller-biased system. Buyer Realtor Consultant means the buyer and seller are always represented by different Realtors with different responsiblities. Today, traditional firms are trying to figure out how they can fully represent both the buyer and the seller so they don't have to split the seller's commission. The truth of the matter is simple: They can't. Attorneys by law can't represent both parties. Realtors shouldn't be allowed to represent both parties. It is the same conflict of interest and it is in direct conflict with the laws of the state. A listing Realtor's/agency's duty is to get the best possible price for their client, the Seller. Realtor helping you house hunt is usually working for the seller and
is legally bound to try to get the seller the highest price. But buyers no
longer have to fend for themselves. You can now enlist a Buyer's Realtor Consultant to
work on your behalf."
